Thumbs up, at first
When Sirius and XM first announced in late February of last year that they wanted FCC and Department of Justice permission to merge, a host of minority advocacy groups filed supportive comments with the Commission. These included the Hispanic Federation, the National Black Chamber of Commerce (NBCC), the League of United Latin American Citizens (LULAC), the Latino Coalition, and the League of Rural Voters.
"For the most part, the mainstream media companies offer very limited music and entertainment programming targeted to the Hispanic community," Hispanic Federation President Lillian Rodriguez-Lopez wrote to the FCC on June 5, 2007. "Satellite radio, by contrast, does provide sought after programming, such as CNN en Espanol, ESPN Deportes, and Mexico Canta."
Many more pro-merger comments followed this statement, among them remarks filed by the National Council of Women's Organizations, a chapter of the African Methodist Episcopal Church, and Women Involved in Farm Economics (that's right: WIFE).
Rethinking the wedding
But the flood of minority and civil rights groups endorsements slowed down by late last year. Then came an October 18th filing from Chester Davenport's Georgetown Partners, a firm based in Bethesda, Maryland, that, in its own words, analyzes FCC regulated communications markets "for opportunities to extend minority ownership and control."

Contrary to earlier filings, Georgetown argued that a merged XM/Sirius threatened minority voices in broadcasting. "Minority programmers today have two completely independent alternatives to attain national programming reach," the statement observed. "However, in the event that the proposed merger is approved without appropriate conditions, there will be but a single entity in control of all 300+ nationwide radio broadcast channels. Failure to obtain carriage through the single licensee, no matter the reason, would preclude nationwide coverage and the consequent ability to aggregate niche audiences."
And so Georgetown proposed that, as a condition of XM/Sirius merger approval, the FCC require the new broadcaster to "sublease on a permanent basis broadcasting infrastructure and sufficient channel capacity to a minority-controlled entity which would enable that entity to be a viable competitor to the post merger Company."
Subsequent comments asked that at least 20 percent of XM/Sirius be leased out to the new broadcaster; that's a swath of spectrum worth about 50 to 100 channels.
"History was against them"
Chester C. Davenport signed these filings. Assistant Secretary for the U.S. Department of Transportation during the Carter presidency, Davenport was described in 1999 by the New York Times as "one of the wealthiest black entrepreneurs in the nation," perhaps worth close to $100 million.
The proposed XM/Sirius merger is not the first FCC deal that his 18-year-old company has attempted to influence. According to the Times, former FCC Chair William Kennard allowed GTE to purchase half of Ameritech's $3.2 billion wireless operation at least in part because the deal also permitted Georgetown to hold 7 percent equity in the new venture, at a cost of $60 million. Kennard was a strong advocate of minority participation in telecommunications.
Davenport appeared at a May 7, 1999, public FCC hearing to advocate his share of the sale. "From the beginning, the nation's communications infrastructure has been owned by members of a single demographic group," he told the gathering. "A large segment of our increasingly diverse nation has the desire and skills to assume ownership of the instrumentalities of communications in this country, but they are excluded from doing so because history was against them. This merger has the potential to change that."
It did. Davenport became chair of GTE Consumer Services, providing cell phone coverage to Greater Chicago and St. Louis.
Davenport's intervention in the proposed XM/Sirius merger has definitely changed the tone of minority filings about the issue. The National Council of Negro Women's (NCNW) statement, submitted in January, called the union a "clear, present, and unmitigated threat to decency" and added that "programming such as Howard Stern, Opie and Anthony, and Bubba the Love Sponge—which help to perpetuate racist and sexist stereotypes in our culture—drive the business of both companies."
On the other hand, the NCNW filing says that the Georgetown Partners proposal "would ensure that at least one competitor in the satellite radio market would be dedicated to providing the American public with robust and positive family-friendly programming."
Ditto for the National Caucus and Center of the Black Aged, the Black Leadership Forum, and Jesse Jackson's Rainbow-Push Coalition—sort of. Jackson's October 31, 2007, FCC filing did not mention Georgetown, but it argued that if the FCC accepts the merger, "it does so with a structure different from the present—one that best serves the public's good and the public's interest."
Various members of Congress have also endorsed the Georgetown proposal, including Representatives Albert R. Wynn of Maryland, G.K. Butterfield, and Gregory Meeks of Jamaica, New York. Federal Election Commission records list Davenport as a contributor to the campaigns of Meeks, Butterfield, and Wynn—$7,000 in Wynn's case. But their November 2007 joint FCC filing includes just as many Congressional signers who have received no money from Davenport. And over three dozen members of Congress have written to the FCC expressing skepticism of the merger in general.
Can Georgetown Partners win?
Since October, Georgetown Partners has submitted 24 comments or ex parte filings to the FCC on XM/Sirius. The latest, filed on Wednesday, argues that in order for the merger to pass antitrust muster with the Department of Justice, the FCC should adopt a "fix it first" strategy, creating a new "competitive entity... before the underlying merger of Sirius with XM is consummated." That new entity, presumably, would be forged along the lines of the Georgetown proposal.
Will Davenport's campaign work? Few FCC watchers are willing to make predictions about the proposed XM/Sirius union any more, given the Commission's record of indecision on the matter. William Kennard, who is black, is no longer the chair of the FCC. And current chair Kevin Martin's record on minority media ownership issues has not inspired many observers.
But the Georgetown Partners plan isn't structurally too far away from the proposals of various media reform groups. The Media Access Project and Public Knowledge both argue that if the FCC accepts XM/Sirius, it should reserve spectrum for non-commercial/educational programming, lease some space to editorially-independent commercial programmers, and require the new entity to open its network up to third-party device manufacturers.
It's possible that the FCC's Republican majority will find in Georgetown's proposal a simpler fix that addresses some of these concerns and improves the agency's record on helping minority broadcasters. But whatever happens, give Chester Davenport credit for changing the debate about the future of satellite radio.

I just tried this and it does work,i have money coming into my paypal account.
Paypal opportunity featured on Oprah
I'm sure you've read these letters asking you to send $1 to six
different addresses. Putting your home address or mailing address on
the internet can be risky, but through PayPal all you have to provide
is your email address. It's safe and easy. Just go to www.paypal.com
and set up your FREE account! No credit card is needed. I am not a
gullible person and have never trusted things like this, but I gave it
a try because I really needed some money fast. Hey, it's only $6. I figured at least 6 people would respond out of the millions of people that use the internet. You should try this too. After all, why not? You hav nothing to lose. Read on for the letter that I found (of course, I added my PayPal e-mail on #6)...
HOW TO TURN $6 INTO $10,000+! THIS REALLY CAN MAKE YOU EASY MONEY!
IT WORKS! BUT YOU HAVE TO FOLLOW IT TO THE LETTER FOR IT TO WORK!
A little while back, I was browsing through newsgroups, just like you
are now and came across an article similar to this that said you could
make thousands of dollars within weeks with only an initial investment
of $6.00! So I thought, "Yeah, right, this has got to be a scam"
but like most of us, I was curious, so I kept reading. Anyway, it said
that you send $1.00 though PayPal to each of the emails stated in the
article. You then place your own email address in the bottom of the
list at #6, and post the article in at least 200 news groups. (There
are thousands) No catch. That was it. So after thinking it over, and
talking to few people first, I thought about trying it. I figured what
have I got to lose except $6.00, right? Like most of us I was a little
skeptical and a little worried about the legal aspects of it. It
follows the same regulations as the "mailed chain letters, which
according to the U.S. Post Office (1-800-725-2161) is indeed legal!
Then I invested the measly $6.00. Well GUESS WHAT!? Within 7 days, I
started getting money in my PayPal account! I was shocked! I figured it
would end soon, but the money just kept coming in. In my first week, I
made about $20.00. By the end second week I had made a total over
$1,200.00! In the third week I had over $10,000.00 and it's still
growing. This is now my fourth week and I have made a total of just
over $36,000.00 and it's still coming in rapidly. It's Certainly worth
$6.00. I have spent more than that on the lottery!
Let me tell you how
this works and most importantly, why it works? Also, make sure you
print a copy of this article now, so that you can get the information
off of it as you need it.

REQUIREMENTS: You must have a confirmed PayPal account. If you do not
have a PayPal account you can go to www.paypal.com and follow the
instructions to set up a free account. In order to place the initial $6
into your account, you will have to confirm your bank account with
PayPal (which may take a few days). PayPal is 100% secure and is used
my millions of people world wide. Confirming a www.paypal.com account
simply means (1) PayPal will first ask you to confirm the email you
used to sign up your PayPal account by sending you an email with a link
for you to click to that email. As soon as you click that link your
email is confirmed. (2) PayPal will then make two small deposits into
your bank account if you set up your PayPal account with a checking or
savings bank account. Or PayPal will make two small deposits to your
credit card if you set up your PayPal account with your credit card.
Then after a few days (it takes up to a few days for these deposits to
appear in your bank account or on your credit card statement) then
after a few days you go back to the www.paypal.com website and sign in.
Then you click where it says this account is not yet confirmed. A
screen will pop up that gives you 2 boxes to fill in. You then enter
the numbers of the 2 small deposit amounts (two separate 2 digit
numbers) that were deposited to your bank account or credit card. Now
you have a working and confirmed PayPal account and can receive
payments.

[STEP 1]
Send, though PayPal, $1.00 to each email on the below list. Make the
subject of the payment "Email List" and in the comments, write "PLEASE
PUT ME ON YOUR EMAIL LIST." What you are doing is creating a service by
this - and best of all you are not giving your address to anyone you do
not know. THIS IS ABSOLUTELY LEGAL! YOU ARE CREATING A SERVICE. Here
are the latest PayPal e-mails on the e-mail lists:
#1) grimbig@live.no
#2) crazymeg86@gmail.com
#3) mistercreep666@yahoo.com
#4) lp-atriot1@hotmail.com
#5) lpassmuk@hotmail.com
#6) jimbo847@comcast.net
Subject of Payment: *Email List*
Comments: *PLEASE PUT ME ON YOUR EMAIL LIST*
[STEP 2]
Now take the #1) email off the list that you see above, move
the other
addresses up one (6 becomes 5 & 5 becomes 4, etc) the put YOUR
email address (the one used in your PayPal account) as #6) on the list.
*MAKE SURE THE EMAIL YOU SUPPLY IS EXACTLY AS IT APPEARS IN YOUR
PAYPAL ACCOUNT*
[STEP 3]
Change anything you need to, but try to keep this article as close to
original as possible. Now, post your amended article to at least 200
newsgroups, message boards, etc. (I think there are close to 32,000
groups) All you need is 200, but remember, the more you post, the more
money you make - as well as everyone else on the list! In this
situation your job is to let as many people see this letter as
possible. So they will make you and me rich! You can even start
posting the moment your email is confirmed. Payments will still appear
in your PayPal account even while your bank account is being confirmed.

DIRECTIONS ON HOW TO POST TO NEWSGROUPS/MESSAGE BOARDS.
[Step 1]
You do not need to re-type this entire letter to do your own posting.
Simply put your CURSOR at the beginning of this letter and drag your
CURSOR to the bottom of this document, and select 'copy' from the edit
menu. This will copy the entire letter into your computer's temporary
memory.
[Step 2]
Open a blank Notepad file and place your cursor at the top of the blank
page. From the 'Edit' menu select 'Paste'. This will paste a copy of
the letter into notepad so that you can add your email to the list.
[Step 3]
Save your new Notepad file as a .txt file. If you want to do your
postings in different sittings, you'll always have this file to go back
to.
[Step 4]
Use netscape or Internet Explorer and try searching for various
newsgroups, on-line forums, message boards, bulletin boards, chat
sites, discussions, discussion groups, online communities, etc.
EXAMPLE: go to any search engine like yahoo.com, google.com,
altavista.com, excite.com, then search with subjects like
"millionaire message board" or "money making message board" or
"opportunity message board" or "money making discussions" or
"business bulletin board" or "money making forum" etc. You will
find thousands and thousands of message boards. Click them one by one
then you will find the option to post a new message.
[Step 5]
Visit these message boards and post this article as a new message by
highlighting the text of this letter and selecting 'Paste' from the
'Edit' menu. Fill in the Subject, this will be the header that everyone
sees as they scroll thru the list of postings in a particular group,
click the post message button. You're done with your first one!
Congratulations! THAT'S IT! All you have to do is jump to different
newsgroups and post away. After you get the hang of it, it will take
about 30 seconds for each newsgroup! *REMEMBER, THE MORE NEWSGROUPS
AND/OR MESSAGE BOARDS YOU POST IN, THE MORE MONEY YOU WILL MAKE! BUT
YOU HAVE TO POST A MINIMUM OF 200* That's it! You will begin receiving
money within days! *JUST MAKE SURE THE EMAIL YOU SUPPLY IS EXACTLY AS
IT APPEARS ON PAYPAL.*

# 2) http://www.resource-a-day.net/member/login.cgi?stanore
# 3) http://www.resource-a-day.net/member/login.cgi?Learamo
My Email is: georgwallace@yahoo.com
Then send a blank email to the (3rd) third person on the list (shown directly above) with your e-mail's Subject Box saying: "I subscribed under #1, Resource-a-day."
Step #2
Copy this info, delete the #1 person, MOVE THE OTHER TWO UP AND
INSERT YOUR RESOURCE-A-DAY LINK AT THE BOTTOM IN THE # 3 POSITION.
Make sure you put in YOUR NEW Resource-a-day URL and YOUR email address correctly!
Step # 3
Now, send this letter to as many people as you can until you receive just 3 emails saying, "I subscribed under #1".
(Now that's it, only 3 responses, not 6 or 10 or 20... just 3). Post it all over message boards everywhere on the internet.
*** (See Below: "How To Post") ****
When your address gets to the # 1 position, you will have 27 people signed up under you! Not bad, but only the beginning!
A short (very short) time later, each of these people will have 27 people signed up under them, and so on, and so on.
After the Fourth Level is done you are $17,000 Richer! (See Calculations Below.)
For each person you signed-up as a subscriber you earn US$0.40 and for each person sponsored by the one you signed-up; and you also earn US$0.20 for each person on the 2nd level! In addition, you also earn US$.05 per member of your 3rd level, and another $.03 per member of your 4th level! And although you see 3 positions on the list before adding your name as you've
signed up, (you've already credited the 1st spot since you're still invisible on the list at this point), and that's why there are Actually 4 Cycles That Go 4 Levels Deep!!! Get It? A bit abstract to understand at 1st, but the
Rock Solid Math Is Definitely There!
**** Only 3 Simple Steps! ****
Sign-Up Under #1 NOW! *** DO THE MATH!!! ***
Calculations Of Earnings:
Your own sign up $10.00
First level 27x $.40=$10.80
Second level 729x$.20=$145.80
Third level 19683x$.05=$984.15
Fourth level 531441x$.03=$15943.23
Total Earned On All 4 Levels = $17,083.98
Now Let's Pretend You Get Really Ambitious With This Program
and shoot for 20 sign-ups instead of 3 which is really easy.
Then Your Income Level Would SOAR & Look Something Like This:
When your address gets to the # 1 position, you will have at least (20*20*20 = 8000) people
signed up under you directly! That is 8000 * $ 0.40 = $ 3,200.00
(and that's only 1 Level!)
And then the 8000 joined under you will bring you a 16,000,000 member down line in the first generation which will bring you 16,000,000 * $.20 = $ 3,200,000.00 U.S. Dollars Total!!!
One thing all statisticians agree upon is that when this program
works at only 10% of the 20 sign-ups goal, you absolutely will be
A Millionaire!
Not bad for 10-20 minutes of work... Don't you agree?
A word of caution: "IF YOU CHEAT, YOU LOSE!!!"
This must cycle upwards through all 3 spots as shown
in the 3 member list above to work.
Foreword:
This System Really works and has created wealth for many
thousands of people. Take the smallest risk of your life.
Take 10-20 minutes to do this. That's your only risk!
HOW TO POST YOUR MESSAGE:
Simply go to google.com and type in the "Search Field" different things like:
"millionaire message boards", "millionaire forums," "money making opportunities message boards," "yahoo money making messages," "posting newsgroups," "posting messages for income opportunities," "one minute millionaire," "financial freedom postings," "internet forum opportunities," "millionaire postings," etc., etc., etc. Also use your imagination to get the word out through your own creativity; as well as typing in
the "Google search field" those 'keys words' for finding message(posting) groups seeking instant wealth as you see in the previous sentence! On-Line classifieds are just another of many ways to advertise! Other search engines besides Google will work as well. (i.e. "Yahoo Search" which is not totally identical to Google)
REMEMBER: THE MORE NEWSGROUPS & MESSAGE BOARDS YOU POST AT, THE MORE MONEY YOU WILL MAKE!!! AS A RULE, IF YOU POST A MINIMUM AT 200 MESSAGE BOARDS, YOU'LL LIKELY MAKE THE 20 SIGN-UP RESPONSES!
THEN YOU CAN KICK BACK ON "EASY STREET" AS THE NEXT MILLIONAIRE AND DO NOTHING BUT COUNT YOUR $$$ MONEY $$$ AS YOUR RESIDUAL INCOME CONTINUES TO ROLL IN NON-STOP!!! "OH HAPPY DAYS!"
